1. Introductory Points.
The blog (also referred to, for the sake of brevity, as the "Blog") is an instrument of social networking that allows each individual to access and/or otherwise use the Blog (hereinafter, for the sake of brevity, the “User” or, when there is more than one, the "Users"), sharing opinions, information, contents and/or materials with other Users.
The Blog is made available to the Users at the address www.blogitalo.it by the company Nuovo Trasporto Viaggiatori S.p.A., registered office in Rome (City and Province), Via G. Mangili, no. 36/A, VAT Number and Tax Code ID 09247981005, entered in the Companies Register of Rome under no. 09247981005, holder of License no. 44, issued on the date of 6 February 2007 by the Ministry of Transportation, pursuant to Legislative Decree no. 188/2003 (hereinafter, for the sake of brevity, also referred to as "NTV").
Through the Blog, NTV intends to offer a channel of communication to address topics tied to the world of transportation, journeys and technology, within a framework of free speech, assuming the latter is exercised legitimately, in accordance with the statutes currently in force in our legal system and in compliance with the present conditions of use for the Blog.

2. Conditions of Use of the Blog.
In order to access and use the Blog, the User must accept in full and respect the present conditions for the use of the Blog (hereinafter, the "
Conditions for the Use of the Blog").
The terms and conditions for use of the internet site internet
www.ntvspa.it (hereinafter, for the sake of brevity, the "
Site") should also be considered a full and integral part of the
Conditions for the Use of the Blog
In addition, the User is required to comply with any further conditions, rules, directives, codes of conduct and/or instructions found in the Blog and/or the Site, or in any part of the same.
3. Access to the Blog. Registration.
In order to access the Blog, the User must complete the following registration procedure.
When Users request to be registered with the Blog, they are asked to provide their personal identifying information. After entering these data, the User shall examine a suitable informative note drawn up on the basis of the measures currently protecting personal data.
The User undertakes to provide information that proves complete, updated and truthful, and to notify NTV of any variation in the data and the information supplied, accepting any and all responsibility in the event of false declarations or incomplete or erroneous indication of the information.
In order to complete the request for registration with the Blog, the User must accept the
Conditions for Use of the Blog (see paragraph 2).
Users shall be able to access the Blog when, after receiving an e-mail of confirmation from NTV, they select the link found in that same e-mail. The User shall then receive an additional e-mail containing a summary of the data entered by the User at the time of registration, as well as the options selected, plus the Conditions for Use of the Blog and the Terms and Conditions for the Use of the Site.
Users may modify the data entered upon registration at any point in time by accessing the section "Modify your Profile".
The request for registration and the
Conditions for the Use of the Blog are available not only in the Italian language, but in English as well.
4. Use of the Blog.
There is no charge for the use of the Blog. As a result, NTV shall not pay any compensation, fee and/or consideration to either Users or third parties for User’s materials sent to and/or uploaded on the Blog.
The messages, comments, information, contents and/or entered or sent by the User to the Blog, or by means of the Blog, are subject to the rules indicated below.
The term “User’s Materials” should be understood as referring to any and all messages, comments, information, contents and/or materials sent, or suitable for sending, by the User to NTV or to third parties (including other Users) by means of the Blog, or entered or loaded by the User on the Blog or on other informatics instruments and/or systems connected to the Blog. To provide merely some of the possible examples, the User’s Materials can include photographs, videos and other types of images, sound materials, graphics materials, documents or data, information, messages, texts, e-mails or other types of communications, files, opinions and other information.
When User’s Materials are transmitted and/or published on the Blog, the User grants to NTV a right of utilisation, valid for commercial and/or statistical purposes as well, without any time limit, provided free of charge and on an irrevocable and non-exclusive basis. This right includes, for example, the copying, sublicensing, reproduction, modification, adaptation, publication, translation, public presentation, exposition and distribution of the User’s Materials, as well as their amalgamation (total or partial) in any form, by any means and with any technology, whether already known or to be developed in the future.
The User declares and guarantees that the User’s Materials have been acquired legitimately and, by sending in the Materials, the User expressly authorises their publication on the Blog.
The User is aware that the User’s Materials sent to the Blog are visible to everyone, meaning that they may be copied, modified, transmitted and/or otherwise distributed by third parties.
At the end of the transmission to/uploading on the Blog of the User’s Materials, the User must enter his or her username and password.
None of the User’s Materials (and especially messages or comments) transmitted to and/or uploaded onto the Blog can be offensive.
Users who wish to record or copy - in all or in part – User’s Materials already published on the Blog must always acknowledge the source.
NTV reserves the right to prohibit and/or impede transmission and/or uploading of any User’s Materials (in particular all messages and/or comments), in addition to being entitled to eliminate/cancel such Materials from the Blog, when NTV holds them to be inappropriate and/or simply unpleasing, based on NTV’s exclusive and discretionary evaluation.
Any User’s Materials (and especially messages and comments) transmitted to and/or uploaded onto the Blog represent nothing other than the User’s point of view. This means that the publication of messages, comments and/or any other User’s Materials does not constitute, nor can it be construed as, an exercise of the profession of journalism, or as a requirement for entry in the register of practicing journalists, as per articles 26 and 33 of Law no. 69 of 3 February 1963.
The Blog is updated, but not on the basis of a predefined period, seeing that the frequency of the postings is not set in advance. As a result, the Blog cannot be considered a published product or a periodical, as these are defined under Law no. 62 of 7 March 2001.
5. Prohibitions and limitations.
The User is expressly prohibited – to give only some of the possible examples – from uploading, communicating, transmitting and/or publishing User’s Materials on the Blog, or through the same, when, to give only some of the possible examples, those materials:
- present content that is pornographic and/or sexually explicit and/or otherwise obscene;
- are offensive and/or defamatory and/or slanderous against anyone whatsoever, and when they include expressions of fanaticism, racism, hate, irreverence and/or threats;
- present content that is racist or foments class discrimination, or that proves otherwise reprehensible;
- promote religions or religious sects or terrorist or extremist movements;
- provide information that is reserved or confidential, including information learned as a result of a working relationship or under a pact of confidentiality;
- violate patents, trademarks, secrets, copyrights or other industrial and/or intellectual property rights of third parties (especially in the case of pirate software, music files, images, videos and texts protected by copyrights);
- contain software, information or other materials capable of transmitting computer viruses or damaging components;
- contain personal data or telephone numbers of the User or third parties, and/or otherwise infringe on the rights of other Users or third parties to have their personal information protected;
- contain information on court proceedings involving the User or third parties;
- portray third parties who have not consented to having their images published on the Blog;
- contain information regarding the health, public or religious opinions, racial origins or sexual habits of third parties;
- portray minors;
- can cause damage, in any way or form, to other Users and/or third parties;
- contain messages and/or information that are encrypted and/or in code;
- contain language that is vulgar, indecent and/or blasphemous;
- promote or provide information on activities that are illegal or illicit, and/or that can damage other Users and/or third parties;
- contain initiatives ties to games of chance, competitions, games and/or wagers of any type whatsoever;
- present contents that amount to advertising or, more in general, that contain promotional, commercial and/or advertising messages/information of any type whatsoever (i.e. the promotion, sponsorship or sale of products and services). A specific prohibition should be understood as regarding the insertion of links, connections and/or other references made for promotional, commercial and/or advertising purposes in the messages and/or comments sent and/or uploaded on the Blog;
- violate, or encourage violations of, any legal and/or regulatory measures of Italy, foreign countries and/or bodies of the European Community.
NTV shall handle the performance, possible drawing on the services of external subjects, of precise and specific activities involving the modernisation of the contents of the Blog, in part to identify and forms of conduct that prove incompatible and/or are in violation of the present Conditions for the Use of the Blog.
In cases where User’s Materials violating the present Conditions for the Use of the Blog have been transmitted and/or uploaded onto the Blog, NTV may – at its sole and binding discretion - :
- refuse to accept/publish the User’s Materials;
- remove and/or modify User’s Materials already uploaded and/or published, without the need for advanced notice;
- suspend, prevent or deny access on the part of the User to the Blog, on a temporary or permanent basis, depending on the seriousness of the violation, without the need for advance noticed and at the discretion of NTV;
- inform the competent authorities, when held to be appropriate.
6. Responsibility.
Users take upon themselves any and all civil, criminal or administrative responsibility generated by, resulting from and/or connected with any accidents and/or damages sustained by individuals, in the past or the present, (including damages to NTV itself, as well as to employees or professionals working for NTV, or to Users and/or to any third parties) and/or to things (including the site, the Blog and/or the informatics systems and/or systems of electronic communications used at the premises of NTV, at the premises of Users or at those of third parties), as a result of the use of the Blog, further undertaking to relieve and indemnify NTV and its personnel from any and all claims, actions, charges and/or demands advanced for any reason with regard to injuries, accidents and/or damages generated by, resulting from and/or connected with the use of the Blog by the User.
7. Trademarks and Distinctive Signs.
".Italo" and "NTV" are registered trademarks of the company Nuovo Trasporto Viaggiatori S.p.A.
Any additional trademark, name, sign, logo, internet address, product or model name or derivatives of the same describing the products or services of NTV, or of the associated enterprises of NTV, or containing the words “.Italo” and/or "NTV", and included in the contents of the Blog is a registered distinctive assign and/or, in any event, the property of NTV or of its associated enterprises.
Other product or company distinctive names or signs used on the Blog may be registered trademarks and/or belong to their respective owners.
The User is expressly forbidden to use, in any manner or form, the distinctive trademarks and signs of NTV or of third parties found on the Blog or that can be acquired with the Blog.
The Blog, the graphics and the texts are subject to copyright laws, and all rights are reserve for NTV or for the legitimate third-party titleholders.
8. Terms and conditions for the use of the Site.
